- Permits are for a maximum of 12 months.
- The number of permits issued per site will be determined by Latrobe City Council.
- Latrobe City Council reserves the right to restrict training, or withdraw use for community/major events and/or conduct repair/maintenance works.
- A permit does not grant exclusivity of the designated area. The area must remain accessible to the general public and Latrobe City Council maintenance staff at all times.
- Latrobe City Council may collect feedback and if complaints are received, review or withdraw the permit.
- Use of advertising like the display of A-frames and/or banners is to be requested in writing and requires council approval.
- Any damage/loss on Latrobe City Council property whilst conducting sessions will require all repair/replacement costs to be met by the Hirer. If costs are not met, the permit will be cancelled.
- If cleaning is required all cleaning costs are to be met by the Hirer. If costs are not met, the permit will be cancelled.
- The Hirer must:
- carry permit during session
- have access to a mobile phone, an emergency contact list and a first aid kit
- leave areas clean and rubbish free after each session
- ensure all waste and recycling is removed and is correctly disposed
- satisfy all Occupational Health and Safety legislation and regulations, and
- apply sun smart practices
- inspect the area for risks/hazards before each session
- remove risks/hazards or alter session to avoid them
- report risks/hazards/issues/incidents/injuries on site to Latrobe City Council
- keep a log book of any injury’s sustained by participants
- have a risk management plan which includes safety procedures and response to emergency situations
- ensure activities do not dominate and/or obstruct any stairway or pathways
- operate activities within the area specified on the permit
- ensure activities are not within 10 metres of any Latrobe City Council owned infrastructure including buildings, playgrounds, public toilets, cricket nets, fencing, monuments or public sculptures
- Not operate in close vicinity of resident properties.
- comply with any relevant legislation, regulations and local laws
- ensure noise created by training activities cannot be heard from residential properties and comply with the EPA noise control guidelines
- always be considerate of other reserve users and adjacent residents
- only provide activities for which they are qualified
- manage activities to minimise wear and tear on grassed areas, including rotating within the booked area and/or alternating activities on sports-specific surfaces, e.g. football/cricket field, soccer pitch, basketball/netball/tennis courts etc
- ensure that any equipment does not create a risk/hazard or obstruction to both participants and non-participants
- not sell services or products on the open space
- not set up and/or attach equipment to trees and/or infrastructure including but not limited to: marquees, weight bench, weight stacks, stationary bikes, punching/boxing bags, treadmills, steppers, tyres
- ensure vehicles are not on sporting fields/recreation reserves/parks/gardens
- not use floodlights
- not block off areas with structures or barricades
- Permission for the hirer to use their own battery powdered lights may be requested in writing to Latrobe City Council.
- The request for use of light is to be outlined on the risk assessment, including amount, positions and specifications. Only battery powered portable lights will be approved.
- Latrobe City Council does not accept liability for any injuries incurred and shall not be responsible for any property left on the site or any loss of property.
- Maximum number of open space allocations is three per permit.
Fees
Fees are listed on the application form. Invoices will be issued monthly.
A bond may be required and payable for the use of parks and reserves. You will be advised when the permit application is approved if a bond is required.
Public liability insurance
Public Liability Insurance will be required to the value of $10 million. A copy of the Public Liability Insurance must be submitted with the application form.
Termination of permit
Latrobe City Council reserves the right to cancel and terminate a Hirer’s permit if deemed appropriate.
If a Hirer is found in clear breach of the permit conditions then Latrobe City Council will:
- Phone the Hirer and request they comply with their permit
- Issue a ‘notice to comply’ final warning letter to the Hirer
- Cancel the permit and request they cease to operate with Latrobe City Council.
- If a Hirer is found conducting commercial training activities on a Latrobe City Council reserve without a permit then an immediate fine will be issued.
The Hirer has the right to object to the cancellation of a permit in writing to the Chief Executive Officer.
Any Hirer that has had a permit terminated in the current year will be ineligible to apply for a permit for the following financial year.
Permit fees will not be refunded at any time.
