Finalising a Section 173 Agreement 


If your planning permit includes a condition requiring a Section 173 Agreement, you must finalise this agreement before works or subdivision can commence.

Latrobe City Council now outsources the preparation and registration of Section 173 Agreements to two approved legal providers:

Legal Providers and Costs

Latrobe City Council has engaged a panel of external legal providers to prepare and manage Section 173 Agreements on behalf of applicants.

Applicants are required to select a legal provider from Council’s approved panel via the online lodgement process. The selected provider will prepare the agreement, manage execution, and arrange registration with Land Use Victoria.

Indicative Costs

The cost of preparing a Section 173 Agreement will vary depending on the complexity, scope, and site-specific requirements of the agreement.
As a general guide:

Standard agreements

Typically relate to straightforward matters such as:

  • Stormwater detention or retention
  • No further subdivision or dwellings
  • Building envelopes
  • Bushfire Management Plan implementation
  • Indicative cost: generally in the range of $1,500–$2,000

Complex or non-standard agreements

May include:

  • Development Contributions
  • Multi lot or multi owner arrangements
  • Contaminated land obligations
  • Agreements requiring bespoke drafting
  • Indicative cost: may exceed $2,000 and will vary depending on complexity

Important Notes

The legal provider will determine whether an agreement is considered standard or complex at the time of lodgement.

Additional costs may apply for:

  • Title searches and registration fees
  • Revisions or extended negotiations
  • Mortgagee consent requirements
  • Council does not set or control legal fees charged by external providers.

Applicants are encouraged to seek confirmation of costs directly from their selected provider prior to proceeding.
