When is a Section 173 Agreement required?

During the assessment of a planning permit application, Council may determine that a Section 173 Agreement is necessary to secure certain outcomes. These may include:

  • Timing of development or infrastructure delivery
  • Restrictions on subdivision or use
  • Developer contributions or off-site works

The requirement for the agreement will appear as a condition on your planning permit.

Next Steps

If your permit includes a condition requiring an agreement:

  • Council will nominate one of our approved legal providers (Maddocks or Harwood Andrews) to prepare the agreement.
  • You will be responsible for providing information and paying legal and associated costs.
