Amendment C131 – Flood Overlays Update

What is Amendment C131?

Amendment C131 implements the recommendation of the West Gippsland Floodplain Management Strategy (2018-2027) to update flood mapping that is informed by two flood studies; the Latrobe River Flood Study (2015) and the Traralgon Flood Study (2016). The studies prepared revised Floodway Overlay (FO) and Land Subject to Inundation Overlay (LSIO) mapping based on updated flood modelling.

Amendment C131 seeks to review and update the extent of existing flood overlays, which were last updated in 2012. Additional flood mapping has become available for areas including the Latrobe River, Eaglehawk Creek, Rintouls Creek and urban Traralgon. Approximately 1,531 properties will have flood overlays added or amended on their land, and 335 properties will have flood overlays removed from them.

Land use planning is recognised as being the best means for avoiding future flooding problems. Through careful planning, flood risks to life, property and community infrastructure can be minimised and environmental significance of floodplains protected.

The provision of updated flooding information within the planning scheme will have a net community benefit by ensuring that the risk of flooding is properly considered in future planning and that risks from flooding may be managed and minimised. The updated mapping will equip Council to plan for future growth in low-risk locations to minimise the impact of natural hazards on the community, development, and infrastructure.

The Amendment applies to all land within the municipality which is informed by the flood modelling within the flood studies.

The Amendment proposes to:

Planning Policy Framework

  • Amend Clause 02.04 (Strategic Framework Plans) to include a new Strategic Framework Plan,
  • Amend Clause 11.01-1L (Glengarry) to include a new Glengarry Town Structure Plan (GTSP),

Operational Provisions

  • Amends the Schedule to Clause 72.03 (Schedule to Clause 72.03 What Does This Planning Scheme Consist Of?) to reflect the amended FO/LSIO mapping,

Amend Flood Overlay (FO and LSIO) Mapping

  • Deletes the following LSIO-FO Map Nos. 2LSIO-FO, 5LSIO-FO, 6LSIO-FO, 7LSIO-FO, 8LSIO-FO, 9LSIO-FO, 10LSIO-FO, and 52LSIO-FO

Current Stage: Post Exhibition

Public Exhibition of the amendment took place between 3 February 2022 and 7 March 2022.

A total of 66 written submissions were received for Amendment C131, with more anticipated to be submitted in the period prior to submissions being presented to Council for consideration.

Assessment of submissions will require collaboration with the West Gippsland Catchment Management Authority (WGCMA) due to their complexity, which will require additional time before a report can be presented to Council to progress it to the next step in the Amendment process.

Once submissions have been assessed, and where possible addressed, the matter will be presented to the Ordinary Council Meeting on 1 August 2022, where Council officers will seek a resolution to progress to a Planning Panel.

Submitters will be notified and provided with the opportunity to attend future Council Meetings and any public hearing held to consider submissions.

Due to current restrictions in place, pursuant to Part 5.5 Section 205(1) of the COVID-19 Omnibus (Emergency Measures) Act 2020, please see below a copy of submissions made to the amendment.

Publication of these submissions online is an approved temporary measure to meet Council’s requirements under Section 21(2) of the Planning and Environment Act 1987 which states that:

"the planning authority must make a copy of every submission available at its office for any person to inspect during office hours free of charge until the end of two months after the amendment comes into operation or lapses”.
