Planning Permits & Statutory Planning

The Statutory Planning team administers the Latrobe Planning Scheme.

This includes:

  • considering proposals to subdivide, use and or develop land, and giving notices and issuing permits in accordance with the planning scheme
  • making sure that land is not used or developed in conflict with the scheme's requirements, for example, by a person starting a car wrecking business on a residential block
  • issuing certificates about the zoning and controls on land

Planning Permits & Related Documents

Depending on the type of planning control affecting your land, you may have to obtain a planning permit before you undertake any change of land use, for example, opening a printing works in an existing shop. The best way to find out whether you need a planning permit is to contact the Development Approvals Team. Planning officers at Latrobe City can also offer advice about policy guidelines that must be considered for particular developments.

Planning Certificates

A planning certificate provides information about planning scheme controls which apply to land. Planning certificates are official documents issued under the authority of the Planning and Environment Act. The certificate is used to meet the requirements of the Sale of Land Act 1962. Under this Act the vendor of a property is required to disclose details of the land zoning, and any overlay controls or exhibited proposed amendments to the local planning scheme.

Planning Appeals

If your application for a planning permit has been refused by the Council, or the decision contains conditions which you are not happy about you may seek a review of the decision (an appeal) through the planning division of the Victorian Civil and Administrative Tribunal (VCAT). Objectors can also lodge an 'application for review' with the Tribunal if they are dissatisfied with a decision.

VCAT independently reviews decisions made by Councils about planning permit applications and other planning matters. The State Government appoints VCAT members who are qualified legal practitioners, planners and other specialists.

 

Planning Permit Register Reports

Under the Planning and Environment Act 1987 Section 49(1), we are required to provide a register of all applications, decisions and determinations relating to planning permits. Details of all planning applications are collated monthly and uploaded in month order.  This data is presented in a predetermined format, commencing May 2007 to current.

Complaints

The Latrobe City Council, as the responsible authority, has a duty to comply with both the Planning & Environment Act 1987 and the Latrobe Planning Scheme that it administers.

Compliance not Prosecution

The main emphasis will be on obtaining compliance rather than on prosecuting offenders.  Each case is different and the way the matter is resolved will depend on the individual circumstances.

Complaints generally need to be made in writing

The complaint will be followed up if the person making the complaint is prepared to leave a name and address so that the Council can have further contact with them and if they can give legitimate evidence that an offence has occurred.  It is usual not to disclose the identity of the complainant to others.
